Young Phoenix man avoids predator label during sentencing for sex with Havasu teen

LAKE HAVASU CITY — The perceived age of the victim was a point of contention in the November 21 sentencing hearing for a Phoenix man who twice had sex with a Lake Havasu City teenager.

There is no dispute that Gavin Flohr, now 22, communicated with the 13-year old on Snapchat before driving to Lake Havasu City for a September, 2024 hookup. The defendant drove to the girl’s home, picked her up in the middle of the night and dropped her off back home after they had sex.

Flohr returned a week later and the pair had sex again after a 2:00 a.m. pickup.

Defense attorney Paul Amann said Flohr insists the girl claimed to be of legal age. “It was his firm belief that he was having sex with someone older, that she was 18,” Amann told Mohave County Superior Court judge Lee Jantzen.

“That’s not correct,” Deputy Mohave County attorney Leah Nelson countered. Nelson argued that the victim told Flohr she was 17 during their first encounter before telling him she was 15 on the second occasion.

Amann noted the girl’s father told an officer his daughter might have lied about her age to deceive his client. He also said the victim was 6 ft. tall and appeared older than a young teen.

Nelson said she agreed to a light punishment plea deal for Flohr, based on input and the wishes of the girl and her parents. Sexual conduct with a minor charges are dismissed in exchange for convictions for two counts of attempted aggravated assault of a minor with sexual motivation.

“I don’t believe you’re a sexual predator,” Judge Jantzen told Flohr.

Jantzen imposed a five day jail sentence, and credited Flohr with five days served. He placed Flohr on probation for three years and ordered him to perform 80 hours of community work service.
