Lake Havasu man gets probation for desert assault on 16-year-old

LAKE HAVASU CITY — A Lake Havasu City man who pummeled a teenager during a fight in the desert will avoid prison if he complies with terms of a plea agreement entered Jan. 30 in Kingman.

The deal unveiled at the Mohave County Law and Justice Center involves an aggravated assault conviction for Nathan Upton, 23.

Deputy Mohave County attorney Matthew Houston said Upton was present last Aug. 22 where a large group of youth gathered anticipating a fight in the 300 block of Beachcomber Boulevard. He said expected  combatants did not square off, but that Upton assaulted a 16-year-old boy.

Houston told Judge Billy Sipe that the victim was dazed and knocked to the ground when struck from behind by Upton. He said the teenager was unable to defend himself as Upton struck him multiple times.

The victim reportedly suffered abrasions, bruising and lacerations about his body and a two-inch gash to his head that required staples to close.

Though he avoids prison, a 60-day jail term with credit for two days service will be ordered at his March 2 sentencing hearing. He’ll be placed on supervised probation and compliance will keep his conviction designated a misdemeanor offense.
