LAKE HAVASU CITY, Ariz. – A Lake Havasu City resident who asked to be sent to prison when he entered a plea agreement last month reversed course during his Sept. 3 sentencing hearing in Kingman.
“I was just under a lot of duress,” Levi Horner, 37, told Mohave County Superior Court Judge Derek Carlisle. He said his perception of lack of support from family generated mental health issues.
Horner told the court he was now hoping for probation rather than prison. He also said he thought he had permission to access a property on Mandarin Drive, and that there had been a misunderstanding between he and the victims.
Horner previously pleaded guilty to criminal trespass for entering the home without permission on March 9. He reportedly placed his clothes in the dresser of an 11-year-old girl who lived there, and was seen on video surveillance leaving the residence wearing only his underwear.
Horner was also convicted of attempted burglary for another incident at the same property the very next day, on March 10.
Judge Carlisle said such home intrusions frequently rob occupants of their sense of security and reasonable expectation to privacy. He imposed a 2.5-year prison term for Horner.
