KINGMAN, Ariz. – Judge Billy Sipe has ordered a decade behind bars for a Lake Havasu City man after rejecting his request for a new trial in his teen sex case. Javier Gutierrez, 48, was convicted of two counts of sexual conduct with a minor, while the trial jury acquitted him of a third count last month.

Gutierrez was convicted of having sex with his girlfriend’s 17-year-old daughter in April 2025.

“These charges do not define who I am as a human being,” Gutierrez said during the Sept. 14 sentencing hearing in Kingman. “I would just like to spend my days, when I get out, taking care of my family.”

“The conduct that we engage in is exactly who we are,” Sipe said. He said Gutierrez abused a position of trust to take advantage of a teenager.

Judge Sipe ordered five-year terms in the Arizona Department of Corrections for each conviction, and that they run consecutive to one another.
