A Bullhead City woman who talked her way out of a probation-eligible plea agreement now faces risk of substantial prison time if convicted at trial. The deal unraveled during an April 4 change of plea hearing at the Mohave County Law and Justice Center in Kingman.
Brei Zagorsky, 38, pleaded guilty to possession of dangerous drugs for sale involving seizure of more than five ounces of methamphetamine after the vehicle she was driving was pulled over on January 16 in the vicinity of Highway 95 and Marble. She admitted knowing the drugs were in the vehicle and she possessed the key to the locked glove box in which they were found.
Zagorsky told Mohave County Superior Court Judge Derek Carlisle that the drugs were found through an illegal search. She admitted sharing drugs with friends, but denied the sale element embodied in the charge to which she pleaded guilty.
“Those drugs were for my personal use,” Zagorsky said. Her comments essentially killed the plea deal that involved a range of punishment from probation up to five years in prison.
Attorneys quickly agreed with Judge Carlisle’s assessment that Zagorsky’s denial of sales involvement undermines the factual basis for the plea, which was scuttled.
Carlisle scheduled a final management conference for July 16 and scheduled trial to begin August 18.
Co-defendant Christopher Beals, 35, Zagorsky’s passenger during the January traffic stop, awaits trial for possessing paraphernalia and dangerous drugs for sale.
