LAKE HAVASU CITY – A Lake Havasu City man has entered a plea agreement that will send him to prison for crimes involving his ex-wife and another victim. Monday’s hearing for Allen Kelley, 47, began with his attorney saying no deal had been reached.
“Negotiations have come to a stalemate,” said defense attorney Daisy Mazoff. She said there was no plea deal to unveil and she asked Mohave County Superior Court judge Derek Carlisle to instead schedule a settlement conference.
Kelley intervened at that point, indicating he would accept the state’s last offer rather than engaging in ongoing legal proceedings.
“I realize we’re are a stalemate your Honor, but I’m not in any way, shape or form wanting to drag this thing further,’’ Kelley said. “If you’re willing, I’d just like to sign for the five.”
Kelley was referring to the five year prison term mandated in the plea deal that convicts him of aggravated assault and aggravated harassment by domestic violence. Robbery, burglary, criminal damage and another aggravated assault charge are dismissed.
Deputy county attorney Phillip Delgado said Kelley illegally entered the home of his ex-wife last October while violating a valid Order of Protection that had been issued against him on her behalf. Delgado said the woman’s cousin followed Kelley outside the home where the defendant accelerated his vehicle while apparently trying, but failing to strike him.
Police subsequently arrested Kelley when he attempted to hide in his vehicle in a desert area north of the Lake Havasu and Avalon Avenue intersection.
Judge Carlisle scheduled an April 1 sentencing hearing.
